The Court seeks counsel to represent Plaintiff Austin Lee Monteiro through the conclusion of his case. He is incarcerated at New Castle Correctional Facility. Mr. Monteiro claims that Defendant Dr. Stephanie Riley violated his Eighth Amendment rights by exhibiting deliberate indifference to his polycystic kidney disorder when she denied a formulary exception request for the drug tolvaptan. This claim survived summary judgment because Mr. Monteiro has evidence that the drug was denied due to its cost and Dr. Riley has evidence that she denied it because she believed the risks and side effects of the drug outweighed the potential benefit Mr. Monteiro might receive from it. Trial is set for August 18, 2026, with the final pretrial conference on July 9.
