Plaintiff James Sullivan brings negligence claims against the United States of America under the Federal Tort Claims Act based on allegations that some correctional officers at FCI Terre Haute knew that other inmates were threatening him but did nothing, after which he was attacked. Discovery has closed, and no party filed for summary judgment. There is a pending motion for sanctions against the United States for failure to preserve evidence.
