Mr. Flagg alleges that Correctional Officer Tierney violated his First Amendment rights by retaliating against him for pursuing grievances and violated his Eighth Amendment rights by provoking other inmates to attack him. These claims have survived summary judgment and will be resolved by settlement or trial. The Court is recruiting counsel to represent Mr. Flagg through final judgment. No settlement conference or trial has been set.
