1:24-cv-1133-JRS-MG Jason Schwartz v. Sacton et al (9/16/2025)

Plaintiff Jason Schwartz is currently incarcerated at Indiana State Prison, but his claims involve his incarceration at Pendleton Correctional Facility. Defendants Noah Saxton, Ofc. Clapper, and Dequan Williams are all officers at Pendleton Correctional Facility and they are represented by Deputy Attorney General Allison Mauk. 

Mr. Schwartz alleges that he has a seizure condition and that in November of 2023, he had a seizure. Instead of calling for help, the defendants cuffed him and dragged him down a flight of stairs and back to his cell. As a result, he suffered head injuries and scarring. The Court's screening order allowed Mr. Schwartz's Eighth Amendment excessive force and medical deliberate indifference claims to proceed against the defendants. After engaging in discovery, the parties decided that it would be beneficial to schedule an in-person settlement conference on February 9, 2026 at 9:00am. The Court seeks recruited counsel to represent Mr. Schwartz for the proceedings associated with this settlement conference as outlined in the attached Minute Order from August 22, 2025.
