Benford Davis alleges that he was deprived of necessary surgery for a hernia for over a year while incarcerated at Pendleton Correctional Facility, then deprived of necessary postsurgical care. Summary judgment motions have been resolved, and the following claims will be resolved by settlement or trial: Eighth Amendment claims against Wexford of Indiana, LLC, Dr. Michael Mitcheff, Dr. Martial Knieser, Sheri Wilson, and Jessica Love; and First Amendment retaliation claims against Officer Rachelle Brumfiel. The Court is recruiting counsel to represent Mr. Davis through final judgment.
