PLEASE NOTE THE FOLLOWING IMPORTANT INFORMATION:

  • The INSD Opinions Database is NOT a
    comprehensive collection of decisions of the Court.

For a variety of reasons, many decisions are not available through the on-line database. However, all decisions of the Court are available through the Clerk's Office. If you are looking for a particular decision and do not find it in this database, contact the Clerk's Office (see instructions below).

  • The INSD Opinions Database contains both
    published and unpublished decisions.

If you cite an unpublished decision in a filing, you must attach a copy of that decision. Local Rule 7.1(b). the INSD Opinions Database does not indicate whether an opinion has been published. Copies of decisions printed from the database are not official and might differ from the signed original. Therefore, only copies of the signed original may be submitted to the Court. For instructions on obtaining copies of original decisions, see the section below.

  • Please note that District Court decisions do NOT
    have precedential authority.

Beyond the principles of res judicata or collateral estoppel, decisions listed in the INSD Opinions Database, like all other District Court decisions, are not binding upon any Court.


INSTRUCTIONS FOR OBTAINING COPIES OF ORIGINAL DECISIONS:

To obtain a copy of an original decision for submission to the Court, contact the Clerk's Office for the appropriate division.

  • Pending cases and cases closed within
    the last three years:

Copy requests must be made in writing, using the Copy Request Form, and include the docket entry number ("NR.") for the document requested, which may be obtained from the Case Search section of this website.

Please note: the INSD Opinions Database might not include the complete date on which a decision was issued. Therefore, it might be necessary to search the docket to determine the docket entry number. Copy requests which do not include a docket entry number are subject to a $26.00 records search fee.

Clerk's Office staff will determine the number of pages of the request and determine the cost, based on the rate of 22 cents per page. Staff will then call the requesting party with the cost of the copy work. The copy work will be completed on a first-come, first-serve basis, usually within 48 hours after the Clerk's Office receives payment. Payment should be made in the form of a check, payable to Clerk, U.S. District Court. As an added convenience, the requesting party may pay for the copy work with a credit card (VISA or MasterCard only). The party will need to submit, with the copy request, the type of card, card number, expiration date and the name on the credit card. Telephone requests will be honored only in an emergency as determined by the Clerk, so please plan accordingly.

  • Cases closed more than three years:

The files of cases closed more than three years are maintained by the Federal Records Center in Chicago, Illinois. A $45.00 fee is assessed for retrieval of each of these files; requests and check or money order must be made in writing to the Clerk. A per-page copy charge is added to the retrieval fee. Ordinarily, the file is received from the Federal Records Center within two weeks after the request is mailed by the Clerk's Office to the Federal Records Center.
