Marc T. Warren v. Corizon, Inc., et al, 2:17-cv-0116-JMS-MJD

Plaintiff Marc Warren alleges that while he was incarcerated at Wabash Valley Correctional Facility that he was given medications to which he was allergic even though he informed medical staff of his allergies. He further alleges this was done at least in part because of Corizon policies and practices regarding utilizing only inexpensive medications and treatment options. The Court screened Mr. Warren's Complaint and allowed Eighth Amendment medical claims to proceed against the defendants pursuant to 42 U.S.C. 1983.

The defendants asserted the affirmative defense of failure to exhaust, but after some litigation withdrew the defense. Therefore, the merits pretrial schedule was issued on December 1, 2017.
