Answer: Pursuant to Judge Barker’s November 22, 2000, Order on Organizational Structure and Discovery, "Liaison Counsel are specifically charged with the responsibility for communications between the Court and other counsel, including the receipt and distribution of notices, orders, motions, and briefs, advising parties of developments in the case, convening meetings of counsel, and otherwise assisting in the coordination of counsels’ activities."

Where can I purchase the Manual for Complex Litigation, Third, as referenced in Judge Barker's ORDER REGARDING PRACTICE AND PROCEDURE UPON TRANSFER AND SETTING INITIAL CONFERENCE, issued November 1, 2000?

If my case is subject to a transfer order, but the actual case file has not yet been transferred to the Southern District of Indiana, where should I file documents?

Answer: Transfers under 28 U.S.C. § 1407 become effective with the filing of the Panel's transfer order in the clerk's office of the designated transferee court. The jurisdiction of the transferee court over the action then becomes automatic and complete, and the jurisdiction of the transferor court ceases. Thus, if the transfer order to which your case is subject has been filed in the Southern District, you must make all future filings in the Southern District.

Do I need to file a motion to appear pro hac vice?

Answer: No. Pursuant to Paragraph 5, of the section titled "Practice and Procedure Order Upon Transfer Pursuant to 28 U.S.C. § 1407," of Judge Barker's ORDER REGARDING PRACTICE AND PROCEDURE UPON TRANSFER AND SETTING INITIAL CONFERENCE, issued November 1, 2000, "Counsel who have appeared in a transferor district court prior to the transfer need not enter separate appearances before this court. Motions for leave to appear pro hac vice are not required and are discouraged." (emphasis added).

What rules and standards govern practice in the Southern District of Indiana?

Answer: Counsel are expected to be fully familiar with and to comply with the provisions of the Local Rules of the Southern District of Indiana. In addition, the Court has adopted the Seventh Circuit's Standards for Professional Conduct with respect to the conduct of attorneys. Admission to its Bar constitutes an acknowledgment both of counsel's familiarity with these standards and an agreement to abide by them.
